Joseph Waller served in the Revolutionary War from Georgia, and was in the Continental Line rather than the Militia. He received a Bounty Land Grant in Franklin County, GA in 1784 as a result of his war service. I don't have proof of the Land Grant, but it has been accepted by the DAR.

Joseph appears on the 1807 & 1810 Tax Digests of Baldwin County, GA, and he paid taxes on property in Hancock County which was owned by the orphans of Charles Waller (relationship unknown).

Joseph married Elizabeth Flint on 13 January, 1773 in Granville County,
He wrote his Will on 17 Nov 1817, and it was filed for Probate 2 Nov 1818, so he apparently died in 1818 in Baldwin Co. Elizabeth, his widow, moved to Autauga Co., AL where she died in 1827.


WILL of JOSEPH WALLER, SR.
In the name of God Amen.
I Joseph Waller Senr. of the county of Baldwin and State of Georgia call to mind the mortality of my body do make and ordain this my last will and testament in the following manner and form.

Item 1. I will and bequeath to my two sons Joseph Waller Jr. and Nathaniel Waller all my land whereon I now live containing two hundred and two and a half acres, that after my decease the same be sold and the money thence arising be equally divided between them and that they pay to my beloved wife the Interest of one third parts of the money annually during her life.

Item 2. I will and bequeath to my beloved wife Elizabeth Waller my two negroes Dinahe and Celia to labor and wait on her during her life and that my negroe boy Calvin be hired out amongst my children and the money thence arising be also applied to the support of my wife during her life and that she keep all three of our beads and a horse if she should "choose to keep one also a cow if she wants it.

Item 3. I will that at the decease of my wife my three beads and their furnature be given up to my three daughters, viz. one each to Peggy Sample, Nancy Tool, and Sarah Brown.

Item 4. I will that at the decease of my wife my three slaves above named be sold in my family and the money thence arising be equally divided amongst my four children viz Joseph Waller, Nathaniel Waller, Peggy Sample and Sarah Brown -- Reserving out of the same one hundred and twenty dollars it being one fifth part of what I gave for the said Negroes because I gave her husband Eli Tool an opportunity of joining in my contract for negroes which has been profitable to him.

Item 5. It is also my will that all my movable property note above disposed of except such articles about the house as my wife may have need of be sold and my dues collected and after paying all my lawful debts the remainder be equally divided amongst my five children above named and likewise what of my property left to my wife may remain at her death be also equally divided as above stated (Viz) All that has not been otherwise appropriated above -

I do hereby constitute and ordain this and no other to be my last will and testament hereby Revoking all former wills and testaments by me hitherto named willed or bequeathed.

Ratifying and confirming this and none other to be my last will and testament. I also hereby constitute and appoint my two sons Joseph Waller Jr. and Nathaniel Waller or in case of failure my son-in-law Mack Brown and my friend Edmund Brantly Executors to this my last will and testament.

In witness of which I the said Joseph Waller Senior have hereunto set my hand and seal this seventeenth of November in the year of our Lord Eighteen hundred & Seventeen
